Terms of Service for PapaNoel.chat

1) Introduction

PapaNoel.chat (the "App") is operated by Alfredo Artiles Larralde with domicile in Spain ("we", "us").

By using the App, you accept these Terms. If you do not agree, do not use the App.

2) Eligibility and Adult Consent

• You must be at least 18 years old, or use the App with the consent of a legal guardian.
• You confirm that the account information is accurate and that you have permission to use it.
• If you create profiles for minors, you accept that they will use the App under direct supervision of a responsible adult.

3) Accounts, Profiles and Child Access

• Parents/guardians can create profiles for their children, indicating name, age, context data (likes, wishes, behavior, etc.).
• Use by minors is conditioned on the responsible adult supervising the video call at all times.

4) Minutes, Credits and Expiration

4.1 Available Packages

The App works through prepaid minute packages:

• Package 1: 3 minutes for €4.99 EUR
• Package 2: 6 minutes for €8.99 EUR

Prices may vary depending on your location and are subject to change. The final price will be clearly displayed before completing the purchase.

4.2 Use of Minutes

• Each video call consumes a minimum of 1 minute when started.
• If the call lasts less than one minute, unused minutes are automatically refunded to your account.
• Purchased minutes expire 7 days after purchase.
• Minutes are not transferable and have no real cash value.

4.3 Refund Policy

Due to the digital nature of the service and immediate consumption of minutes:

• No refunds are offered once a minute package purchase is completed.
• Unused minutes within the 7-day period expire automatically and are non-refundable.
• In case of technical problems that prevent use of the service, contact us at help@papanoel.chat and we will evaluate each case individually.
• This policy does not affect your legal rights as a consumer under applicable legislation, including the right of withdrawal when applicable.

5) Video Calls: AI, Recording and Sharing

Video calls use AI technology to generate voice and movement of the Santa Claus avatar.

You may record, store and share the video call (for example, with family, friends or on social media).

By sharing, you accept that:

• The avatar and its responses are generated by AI. They do not represent real people.
• You are solely responsible for the use, editing or dissemination of the recording.
• You must not present the content as actual statements from a human individual.
• You will comply with applicable legislation regarding data protection, image rights, minors, etc.

6) Acceptable Use

You may not use the App for:

• Illegal, offensive, defamatory or inappropriate purposes.
• Exceeding usage limits, manipulating the minute system or using hacks, reverse engineering, scraping or other methods of abuse.
• Introducing unnecessary sensitive data of minors.
• Commercial, promotional use or outside the intended purpose of the App.

7) Intellectual Property and License

We (or our licensors) own all rights to the software, design, graphics, trademarks and content of the App.

We grant you a limited, non-exclusive, revocable and personal license to use the App in accordance with these Terms.

If you upload or share content (for example, recordings), you retain the rights to that content, unless you grant additional licenses.

8) Changes to Service and Availability

We may modify, suspend or withdraw App features at any time, for maintenance, improvement or operational reasons.

We do not guarantee continuous availability or absence of errors.

9) Termination

You may delete your account at any time.

We may suspend or cancel your access if you violate these Terms or represent a risk to other users or the App.

10) Disclaimers and Limits of Liability

The App is provided "as is" and "as available", without warranties of any kind.

We are not responsible for indirect, incidental, special, consequential or punitive damages, loss of data, profits or reputation.

We do not guarantee that AI-generated content is accurate, safe or appropriate. Any decision based on it is at your own risk.

Nothing in these Terms limits rights that cannot be legally waived, including consumer rights under applicable law.

11) Jurisdiction and Applicable Law

These Terms are governed by Spanish law.

The courts of your autonomous community/domicile (or, if you prefer, those of Córdoba — or those you specify) will have exclusive jurisdiction, unless applicable law provides otherwise.

12) Changes to these Terms

We reserve the right to update these Terms.

If there are material changes, we will inform you through the App or by email. Continued use of the App after changes implies acceptance of the new Terms.
